These Terms of Service (“Terms”) govern your access to and use of the Smart Leak Protection website located at SmartLeakProtection.com (the “Site”) and any services provided by Smart Leak Protection LLC, a California limited liability company (“Smart Leak Protection,” “we,” “our,” or “us”).
By accessing the Site, booking an appointment, requesting a quote, or purchasing services from us, you (“you” or “Customer”) agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

1. Description of Services
Smart Leak Protection provides, without limitation:
Plumbing services and related diagnostics
Consultation, installation, and maintenance of smart water shutoff systems (including Flo by Moen Smart Water Shutoff and similar devices)
Leak detection and plumbing health assessments
Ongoing service plans and related support, where offered
We are an independent contractor/installer and not the manufacturer of Flo by Moen or any other third-party devices. Product specifications, performance, and manufacturer warranties are governed by the manufacturer’s documentation and policies.
Any descriptions of products or services on the Site are for general informational purposes only and do not guarantee availability, specific results, or that a particular solution is appropriate for your property.
2. Eligibility
You may use the Site and engage our services only if:
You are at least 18 years old and able to form a binding contract; and
You have authority to enter into these Terms on behalf of yourself or the property owner.
By using our services, you represent and warrant that you meet these requirements.
3. Estimates, Proposals, and Service Appointments
3.1 Estimates and Proposals
Any estimate, proposal, or quote we provide (written or verbal) is non-binding and based on the information available at the time.
Final pricing may change if site conditions, scope, or materials differ from initial assumptions.
We may require a signed estimate/authorization before commencing work.
3.2 Access to Property
You agree to:
Provide safe, timely access to the property, including any required gates, panels, and utility areas.
Ensure that someone with authority to approve work is available (or reachable) during the appointment.
If we cannot access the property or work area at the scheduled time, we may charge a trip fee or reschedule at our discretion.
3.3 Scheduling, Rescheduling, and Cancellations
We use third-party systems (such as GoHighLevel) to manage booking, reminders, and communications.
You agree to provide accurate contact information (phone, email) so we can confirm and coordinate appointments.
We may charge a cancellation or rescheduling fee for appointments cancelled or rescheduled with insufficient notice, especially if travel and prep have already occurred. Specific policies may be communicated in your estimate or confirmation email/text.
4. Pricing, Payments, and Billing
4.1 Payment Methods
We generally accept payment via Stripe (credit/debit cards) and other methods as communicated (e.g., check, ACH, or cash in certain cases).
By submitting payment information, you authorize us and our payment processor (e.g., Stripe) to charge the applicable amounts, including taxes and any agreed-upon fees.
4.2 Due Dates and Late Payments
Unless otherwise specified in writing, payment is due upon completion of services.
For invoices allowed to be paid later, you agree to pay within the stated terms (e.g., net 7, net 15, or net 30).
We reserve the right to charge late fees, interest, or collection costs to the maximum extent allowed by California law if invoices are not paid on time.
4.3 Deposits and Special Orders
For larger jobs or materials that must be specially ordered, we may require a deposit before work begins.
Deposits may be non-refundable once materials have been ordered or work has started, except as otherwise required by law or stated in your contract.
5. No Emergency or Life-Safety Services
Our services are not a substitute for emergency response. Smart leak shutoff systems are designed to help detect and mitigate water damage but do not replace:
Calling 911 in an emergency
Contacting your utility company or fire department when appropriate
Notifications, app alerts, and remote monitoring features are provided “as available” and may be affected by internet outages, device failures, power interruptions, or third-party systems outside our control. You remain responsible for regular inspections of your property and for responding appropriately to any water leaks or emergencies.
6. Manufacturer Products and Warranties
6.1 Flo by Moen and Other Third-Party Devices
Where we install a Flo by Moen Smart Water Shutoff or other third-party device:
The device itself is covered by the manufacturer’s warranty, not by Smart Leak Protection.
You are responsible for registering your product, maintaining required Wi-Fi connectivity, and following the manufacturer’s instructions.
Our responsibility is limited to the workmanship of our installation and any specific service agreement we enter into with you.
6.2 Workmanship Warranty
We may provide a limited warranty on our labor (for example, correcting installation issues caused by our workmanship) for a specified period after completion, as set out on your invoice or service agreement.
This workmanship warranty does not cover:
Manufacturer defects in products
Damage caused by misuse, neglect, modifications by others, failure to maintain, freezing conditions, excessive pressure, or events beyond our control (e.g., earthquakes, fires, floods, power surges)
Work performed by other contractors or DIY modifications after our installation
Any extended or separate warranties will be stated explicitly in your service documentation.
7. Use of the Site and Communications
7.1 Site Content and Information
All content on the Site (including text, images, graphics, logos, and design) is owned or licensed by Smart Leak Protection and is protected by intellectual property laws.
You may:
View and print content for your personal, non-commercial use related to evaluating or using our services.
You may not:
Copy, distribute, modify, or create derivative works from our content without our prior written consent.
Use any data mining, robots, or similar data-gathering tools on the Site.
7.2 User Accounts
If we provide a user portal or account access:
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activities that occur under your account.
You agree to notify us promptly of any unauthorized access or security breach.
We reserve the right to suspend or terminate accounts that violate these Terms or disrupt Site operations.
7.3 SMS, Email, and Automated Communications
By providing your phone number or email address, you consent to receive:
Appointment confirmations and reminders
Service-related updates and follow-up messages
Occasional marketing messages about our services and special offers (where permitted by law and our Privacy Policy)
You can opt out of marketing messages at any time (for example, by replying “STOP” to SMS campaigns or using unsubscribe links in emails). Service-related communications that are necessary to complete your booking or provide services may still be sent.

You agree not to use the Site or our services:
For any unlawful purpose or in violation of applicable laws or regulations
To attempt to gain unauthorized access to the Site, our systems, or other users’ information

To the maximum extent permitted by law:
No guarantee of specific outcomes. We do not guarantee that any leak detection system will prevent all water damage or that your insurance carrier will provide discounts or coverage benefits.
“As is” Site. The Site and any informational content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied.
Internet and connectivity. We are not responsible for issues arising from your Wi-Fi, internet provider, electrical systems, or other infrastructure that may affect device performance or alert delivery.
Nothing in these Terms is intended to disclaim any warranties that cannot be excluded under applicable law, but our liability is limited as described below.
11. Limitation of Liability
To the fullest extent permitted by California law:
Smart Leak Protection and its owners, members, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages (including lost profits, loss of use, or loss of data) arising out of or relating to the Site, our services, or any devices installed.
Our total aggregate liability for any claim arising out of or relating to these Terms, the Site, or the services provided to you is limited to the amount you actually paid to Smart Leak Protection for the specific service giving rise to the claim.
This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow limitations of liability for certain damages; in such cases, our liability will be limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Smart Leak Protection LLC and its members, managers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Any misrepresentation you make regarding your authority to authorize work on a property
Your negligence or intentional misconduct

16. Entire Agreement
